Sportlygist (“we,” “our,” or “us”) respects the intellectual property rights of others and expects its users and contributors to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement committed using the Sportlygist website (the “Site”) that are reported to our Designated Copyright Agent.

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through our Site by completing the following DMCA Notice of Alleged Infringement.

1. How to File a DMCA Takedown Notice

To file a notice of infringement with us, you must provide a written communication (by email or regular mail) that sets forth the items specified below.

Your DMCA Takedown Notice must include:

  1. Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

  2. Identification of Copyrighted Work: Identify the copyrighted work claimed to have been infringed. If multiple copyrighted works on our Site are covered by a single notification, provide a representative list of such works.

  3. Identification of Infringing Material: Identify the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled. Provide information reasonably sufficient to permit us to locate the material (e.g., the exact URL/link of the page containing the material).

  4. Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address.

  5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  6. Accuracy and Perjury Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Where to Send Your Notice

Upon receipt of a valid DMCA notice, we will investigate the claim and take appropriate action, which may include removing or disabling access to the challenged material.

3. DMCA Counter-Notification Process

If you believe that your content was removed (or access was disabled) by mistake or misidentification, you may submit a Counter-Notification to our Copyright Agent.

Your Counter-Notification must include:

  1. Your physical or electronic signature.

  2. Identification of the material that has been removed and the location (URL) where the material appeared before it was removed.

  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts in your current location, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

If a valid counter-notice is received, we may send a copy to the original complaining party informing them that we may replace the removed content in 10 to 14 business days, unless the copyright owner files an action seeking a court order against the content provider or user.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Sportlygist has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the publishing rights or accounts of contributors, users, or authors who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Site for any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

5. False Claims Warning

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees. We recommend that you consult with legal counsel before submitting a Notice or Counter-Notice.
